{"id":1164,"date":"2023-09-11T10:00:38","date_gmt":"2023-09-11T01:00:38","guid":{"rendered":"https:\/\/oiea.jp\/en\/?p=1164"},"modified":"2023-09-11T10:00:42","modified_gmt":"2023-09-11T01:00:42","slug":"dont-underestimate-japans-cosmetologists-act","status":"publish","type":"post","link":"https:\/\/oiea.jp\/en\/dont-underestimate-japans-cosmetologists-act\/","title":{"rendered":"Don\u2019t Underestimate Japan\u2019s Cosmetologists Act!"},"content":{"rendered":"\n<p>There are many foreigners who, for a variety of reasons (i.e., they didn\u2019t know, it\u2019s not against the law in their home countries, etc.), commit crimes and face legal punishment in Japan. One might feel sorry for these foreign nationals who are accused of breaking the law, but persons who perform beauty treatments without a license put clients at risk.<\/p>\n\n\n\n<p>A cosmetician (<em>biy\u014dshi<\/em>\/\u7f8e\u5bb9\u5e2b) is \u201ca person who is engaged in the beauty business,\u201d and must be licensed by the Ministry of Health, Labor, and Welfare under the Cosmetologists Act (<em>Biy\u014d Shih\u014d\/<\/em>\u7f8e\u5bb9\u5e2b\u6cd5). This is regardless of whether or not that person will collect a salary from their activities. Persons without a license <strong>cannot<\/strong> perform or engage in beauty services.&nbsp; <\/p>\n\n\n\n<p>\u2018Beauty\u2019 is defined as \u201cimproving one\u2019s appearance by means of a permanent wave [perm], hairdressing, cosmetics, etc.;\u201d the acts of dying one\u2019s hair and getting eyelash extensions are also included in this definition.<\/p>\n\n\n\n<p>\u2018Beauty business\u2019 pertains to hair coloring, styling, perms, and hair cutting; it also includes nail care, eyelash extensions, facial treatments, etc. These treatments and services <strong>cannot be performed<\/strong> without a valid license.&nbsp;&nbsp;<\/p>\n\n\n\n<p><strong>Punishments for breaking the Cosmetologists Act: \u00a0<\/strong><br>As stated in Article 6 of the Cosmetologists Act, \u201cIt is not permissible for someone to engage in beauty business activities\/services if he or she is not a cosmetologist.\u201d Anyone in violation of this law is punishable by a fine of up to \u00a5300,000.\u00a0<\/p>\n\n\n\n<p>So, does this mean that someone has broken the law if they cut their friend\u2019s or family\u2019s hair, regardless if they have their permission and\/or whether it was done for profit?<\/p>\n\n\n\n<p>In principle, it is <em>not<\/em> a crime so long as someone does not provide services as a business, but caution is necessary. There are situations where someone\u2019s activities and services may be recognized as being a business even if that was not their intention in the first place. Penalties apply to cases like this so please be careful.&nbsp;<\/p>\n\n\n\n<p>Cutting another person\u2019s hair without their consent is an act which causes harm to that person. Therefore, it may be considered a crime of inflicting injury under Article 204 or as assault under Article 208 of the Penal Code.
